Sean Kelly and Timothy Jung successfully represented Hubbard County before the Minnesota Court of Appeals in Hubbard County v. Card, securing a full reversal and remand in a precedential opinion issued August 10th. The Court of Appeals confirmed two critical points of law affecting Section 299A.465 health insurance coverage benefits: first, that the 2025 legislative amendments restricting employer challenges to PERA duty-disability determinations do not apply retroactively to pending petitions; and second, that under the applicable statute, public employers qualify as “persons” with the statutory right to petition for contested-case review. This decision allows public employers to contest past 299A cases where the challenge was initiated before the 2025 legislative amendment became effective.
